Please read these Terms before booking. By placing a booking, paying an invoice, accepting a quotation, or using the Room, the Hirer agrees to these Terms. The person making the booking confirms that they are at least 18 and have authority to bind the Hirer and every attendee for whom they are responsible.

1. Definitions

In these Terms: “we”, “us” and “our” mean Zak Wood, trading as The Murley Room; “Hirer” and “you” mean the person, business or organisation named in the booking; “Room” means The Murley Room and any facilities included in the booking; “Premises” means the building and associated areas made available to the Hirer; “Booking” means the accepted reservation described in the booking confirmation; and “Attendee” means any guest, delegate, supplier, contractor or other person attending in connection with the Booking.

If there is a conflict between these Terms and the booking confirmation, the booking confirmation takes priority only for the specific commercial detail concerned, such as the date, time, price or agreed layout.

2. Bookings and formation of the contract

An enquiry, availability indication or provisional hold is not a confirmed Booking. A Booking becomes binding when we send written confirmation and any required payment has been received by its due date.

Bookings are subject to availability, the stated capacity, the intended use being acceptable to us, and any information we reasonably request. We may refuse an enquiry before a Booking is confirmed.

  • The Hirer must check the date, access time, finish time, price, layout, attendee number and included facilities in the confirmation.

  • Any change must be agreed by us in writing. Additional time, services, furniture changes or equipment may incur an additional charge.

  • The Room may not be sublet, resold or transferred to another organiser without our prior written agreement.

3. Prices, payment and security deposits

The price is the amount shown in the booking confirmation or invoice. Unless stated otherwise, payment is required in full to confirm the Booking. We are not required to provide access while any amount is overdue.

Prices include only the facilities and time expressly stated. The Hirer is responsible for bank charges, chargebacks improperly raised, agreed extras, overtime, specialist cleaning, repair or replacement costs, and other sums properly due under these Terms.

We may require a refundable security deposit for higher-risk events, larger groups, external catering, alcohol, or bookings involving equipment or unusual activities. We will state the amount and conditions before confirmation. Any undisputed balance will normally be returned within 10 working days after the Booking.

4. Cancellations and changes by the Hirer

A cancellation or request to change a Booking must be sent to the booking email address and is effective when received by us. Unless a different cancellation policy is stated in the booking confirmation, the following applies:

  • More than 7 clear days before the start time: refund of amounts paid, less any non-refundable third-party cost that was clearly disclosed and specifically incurred for the Booking.

  • Between 48 hours and 7 clear days before the start time: 50% of the room-hire charge remains payable.

  • Less than 48 hours before the start time, or non-attendance: 100% of the room-hire charge remains payable.

  • We may, at our discretion, allow one transfer to another available date. A transfer is not confirmed until agreed in writing and may be subject to a price difference.

Nothing in this section limits any statutory right that cannot lawfully be excluded. Where the Hirer is acting as a consumer, these Terms will be interpreted consistently with applicable consumer law. A booking of leisure or accommodation-type services for a specific date or period may not carry the standard 14-day distance-contract cancellation right; if the legal exception does not apply, we will honour any cancellation right required by law.

5. Cancellation or disruption by us

We may cancel, suspend or end a Booking where the Room is unsafe or unavailable, payment is overdue, the intended use is unlawful or materially different from that disclosed, these Terms are seriously breached, or continuing the Booking would pose a material risk to people, property, security or our business.

If we cancel because of a matter within our reasonable control and the Hirer is not at fault, we will offer a reasonable alternative date or refund the room-hire charge paid for the affected Booking. This will be the extent of our contractual responsibility for the cancellation, except where the law does not permit that limitation.

We are not responsible for delay or failure caused by events outside our reasonable control, including severe weather, utility or internet failure, fire, flood, epidemic, government action, transport disruption or emergency works. We will take reasonable steps to minimise disruption and, where fair in the circumstances, offer a transfer, credit or refund for services not supplied.

6. Access, times and security

Access is limited to the times in the booking confirmation, including setup and clearing away. The Hirer must not enter early or remain after the finish time without permission. Overtime may be charged at the then-current rate, rounded up to the charging interval stated in the booking confirmation.

Door PINs, QR codes, keys and other credentials are issued for the Booking only. They must be kept secure, used only by authorised attendees, and not published or forwarded beyond those who need them. The Hirer must ensure that doors are not propped open and that unauthorised persons are not admitted.

The Hirer must follow check-in, locking-up, alarm, emergency and departure instructions. Lost keys, cards or equipment, and call-outs caused by failure to follow instructions may be charged at reasonable cost.

7. Capacity, supervision and conduct

The number of people on the Premises must not exceed the capacity stated in the booking confirmation or any fire-safety limit displayed at the Premises. The Hirer is responsible for attendee behaviour and must nominate a responsible adult who remains present throughout the Booking.

Children and vulnerable people must be appropriately supervised by the Hirer. We do not provide care, childcare, safeguarding supervision or event security unless expressly agreed in writing.

The Hirer must ensure that attendees act lawfully, respectfully and without nuisance. We may require a person to leave, or end the Booking, where conduct is threatening, abusive, discriminatory, unsafe, excessively noisy, destructive or seriously disruptive. No refund will be due where termination results from the Hirer’s or an attendee’s serious breach.

8. Permitted and prohibited use

The Room may be used only for the purpose stated in the Booking. Prior written permission is required for public ticketed events, retail sales, amplified music, external catering, alcohol, filming for commercial distribution, exercise involving unusual risk, animals other than assistance dogs, or any activity needing a licence or special insurance.

  • Smoking and vaping are prohibited inside the Premises.

  • No illegal drugs, weapons, naked flames, candles, smoke machines, hazardous substances or activities likely to trigger alarms are permitted.

  • Nothing may be fixed to walls, doors, ceilings or furniture without permission. Confetti, glitter and similar difficult-to-clean materials are prohibited unless expressly agreed.

  • The Hirer must not use the Room for unlawful, fraudulent, indecent or discriminatory activity, or in a way that infringes another person’s rights.

9. Food, drink and alcohol

Complimentary tea and coffee, where provided, are self-service and subject to availability. The Hirer must use kitchen facilities safely, clean spills promptly and leave food-preparation areas tidy.

Unless we expressly agree to provide catering, the Hirer is responsible for all catering arrangements, food hygiene, allergen information and dietary requirements. External caterers must be competent, appropriately insured and approved by us where requested.

Alcohol may not be sold. Alcohol may be brought onto or consumed at the Premises only with our prior written permission and in compliance with licensing law. We may prohibit service to anyone who appears underage or intoxicated and may end the Booking if alcohol creates a safety or nuisance risk.

10. Furniture, equipment and room layout

The Hirer must use furniture and equipment with reasonable care and follow any operating instructions. Furniture must not obstruct exits, fire equipment, access routes or ventilation. Only agreed layouts may be used where moving furniture presents a manual-handling or damage risk.

The Hirer must test presentation equipment, adapters and online services in reasonable time. Unless specifically included, we do not guarantee compatibility with the Hirer’s devices. The Hirer should bring any specialist adapter and maintain a backup copy of important presentation material.

Items left at the Premises are at the Hirer’s risk. We may retain found property for 28 days and then dispose of or donate it where lawful. Reasonable postage or storage charges may apply.

11. Wi-Fi and technology

Guest Wi-Fi is provided as a convenience and is subject to availability, maintenance, coverage and upstream service. We do not guarantee uninterrupted service, a particular speed or suitability for a critical broadcast, examination, transaction or confidential activity.

Users must not attempt unauthorised access, introduce malware, interfere with networks or security systems, infringe intellectual-property rights, send unlawful or abusive material, or carry out excessive activity that degrades service for others. We may restrict or disconnect access to protect the network or comply with law.

The Hirer remains responsible for the security of its devices, accounts and data, including the use of encryption, strong passwords, multi-factor authentication and an appropriate VPN where needed.

12. Cleanliness, damage and reinstatement

The Room must be left reasonably clean, tidy and in the condition in which it was provided. Waste must be placed in the designated bins, furniture returned as instructed, windows closed, appliances switched off where directed, and all personal items removed.

The Hirer must report any damage, fault, spill, accident or security incident promptly. The Hirer is responsible for loss or damage caused by the Hirer or attendees, except for fair wear and tear or matters caused by us.

We may charge the reasonable evidenced cost of additional cleaning, repair, replacement, locksmith attendance, alarm call-out or loss arising from a breach. We will provide a breakdown on request and will not charge more than our reasonable loss.

13. Health, safety, fire and accessibility

The Hirer must comply with safety notices, emergency instructions and reasonable directions from our staff. Fire exits, extinguishers, alarms and access routes must remain unobstructed. The Hirer must familiarise the responsible adult with exits and account for attendees in an evacuation.

Accidents and near misses must be reported promptly. In an emergency, call 999 first where appropriate and then contact us using the emergency details supplied with the Booking.

The Hirer must tell us before booking about material accessibility needs or planned activities that may require adjustments. We will consider reasonable requests, but the Hirer must check that the Room and facilities meet its specific needs before confirmation.

14. Insurance, licences and permissions

A business, charity, club, trainer, event organiser or other non-private Hirer must maintain insurance appropriate to its activities, including public liability insurance where reasonably required. We may request evidence before granting access.

The Hirer is responsible for obtaining licences, consents, permissions and risk assessments required for its activity, including music, entertainment, raffles, sale of goods, regulated training, photography or the serving of alcohol. Our acceptance of a Booking does not confirm that the Hirer has met those obligations.

15. Liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of statutory rights that cannot be excluded, or any other liability that cannot lawfully be limited.

Subject to the previous paragraph, we are responsible for loss or damage that is a reasonably foreseeable result of our breach of contract or failure to use reasonable care and skill. We are not responsible for loss that was not reasonably foreseeable when the contract was made, or for loss caused by the Hirer, an attendee or a third party outside our control.

Where the Hirer books wholly or mainly for business purposes, we are not liable for loss of profit, revenue, business, opportunity, anticipated saving, goodwill, data or business interruption. For business Hirers, our total contractual liability arising from a Booking will not exceed 150% of the total room-hire charge paid or payable for that Booking, except for liability that cannot lawfully be limited.

A consumer’s statutory rights are not affected.

16. CCTV, privacy and photographs

CCTV may operate in external, entrance, access and shared areas for safety, security, crime prevention and protection of people and property. CCTV is not used in toilets. Signage and our privacy information explain who controls the footage, why it is used, retention and how to exercise data-protection rights.

We process booking and contact information to administer the Booking, take payment, provide access, communicate about the hire, protect the Premises and meet legal obligations. Further details are set out in The Murley Room privacy notice and any CCTV notice made available at booking or at the Premises.

The Hirer must obtain any consent or other lawful basis needed before photographing, filming or recording attendees, and must respect any instruction designed to protect privacy. We will not use identifiable images of the Hirer or attendees for marketing without an appropriate lawful basis.

17. Complaints and disputes

Please raise a concern as soon as possible so that we have a fair opportunity to put matters right. Formal complaints should be sent to the booking email address and include the booking reference, relevant dates and the outcome sought. We will aim to acknowledge a complaint within 5 working days and provide a substantive response within 15 working days.

If part of these Terms is found unlawful or unenforceable, the remaining provisions will continue in effect. A delay in enforcing a right does not waive that right. No person other than the Hirer and Zak Wood has a right to enforce the contract under the Contracts (Rights of Third Parties) Act 1999.

These Terms and the Booking are governed by the law of England and Wales. The courts of England and Wales will have jurisdiction, except that a consumer resident elsewhere in the UK may also benefit from any mandatory right to bring proceedings in their home jurisdiction.
